The bill allows homeowners to take action on their property without prior HOA approval and to take greater control over their own land.

Thanks to Bill 1588, Texas HOAs can no longer restrict a fence or gate around a homeowner’s front yard or driveway. However, HOAs can still mandate the type of fence that has to be used, such as wood or chain link. If it’s stated in the HOA covenants, homeowners will still need approval for the material, but not for the fence itself.

Capped Resale Certification Fees

Resale certification fees are capped at $375, and updated resale certification fees are capped at $75. The HOA now has five days instead of seven to deliver the updated certificate. Under Bill 1588, homeowners can seek up to $5,000 from the HOA if the organization doesn’t provide the certificate on time.

Better Home Security 

Now, you don’t have to get anyone’s approval to install a home security camera or motion sensors on your property. While HOAs can still prevent homeowners from installing security measures beyond their property, owners remain entirely in control of what they place on their own.
